  • Arson: Arson is the act of intentionally setting a fire or causing an explosion. While a minor arson charge is a misdemeanor, an arson charge can be elevated to an A-1 felony if a death occurred. Depending on the circumstances surrounding your case, you can be charged with arson in the first, second, third, or fourth degree.
  • Assault: In New York, you can be charged with assault in the first, second, or third degree. You can be charged with assault in the third degree if you intentionally/recklessly caused injury to another person or if you were criminally negligent with a weapon. If serious physical injuries resulted and the assault was carried out with the intent of causing these injuries, you can be charged with assault in the second degree. You can be charged with assault in the first degree if you caused serious physical injury to an individual by using a deadly or dangerous weapon/instrument.
  • Attempted Murder: An attempted murder charge is a Class A-1 felony. You can be charged with attempted murder in the first and second degree. If you are charged with attempted murder in the first degree (you acted with intentionality and premeditation), you are facing a minimum of 20 years to life in prison. If you are charged with attempted murder in the second degree (you acted without premeditation and/or in a fit of passion), you are facing a 5 to 15-year prison sentence. To be convicted of attempted murder, it must be established that the defendant took a direct step towards killing the victim in question and that there was intent to kill.
  • Burglary: Burglary charges can range from a D felony (punishable by up to 7 years in jail) to a B felony (punishable by up to 25 years in prison). In New York, you can be charged with burglary in the third degree, second degree, or first degree. Burglary charges are often associated with other charges such as “criminal possession of a weapon” and “assault.”
  • Domestic Violence: A domestic violence conviction can adversely impact your life for years to come. If convicted, you will not be allowed to carry a gun and you can also face career and deportation repercussions.   • Hazing: Hazing is a common problem on college sports teams as well as in fraternities and sororities. Hazing is when, in order to gain membership into a group, an individual is subject to humiliation, abuse, or a degrading or harmful activity. You can be prosecuted for hazing if you did something that intentionally or recklessly created substantial risk of injury to another person and that person did sustain such an injury. Hazing is a Class A misdemeanor.
  • Possession of a Weapon: While being arrested for possessing a switchblade knife or gravity knife in New York is a fourth-degree misdemeanor violation and can result in up to one year in jail, more serious charges fall under this category. If you were found, without a permit, in possession of a loaded gun, pistol, revolver, or firearm outside of your home or place of business, you will be facing a second-degree charge, which carries a minimum prison sentence of three and a half years.
  • Robbery: If you are accused of forcibly stealing the property of another, you could be facing first, second, or third-degree robbery charges. Third-degree robbery involves stealing something by use or threat of physical force. Second-degree robbery involves stealing property, acting with an accomplice at the scene, displaying a weapon, causing physical harm, and/or stealing an automobile. First-degree robbery involves stealing property and causing serious physical harm to a person while armed with a deadly weapon or using threats or displaying a firearm.
  • Stalking: Criminal stalking is the act of maliciously and willfully harassing a victim and posing a credible threat of harm to them. Oftentimes, stalking involves violating restraining orders. Stalking is frequently a problem among estranged partners and spouses. You can be charged with stalking in the first, second, third, or fourth degree. Depending on the circumstances surrounding your case, you could be facing a Class B misdemeanor all the way up to a Class D felony.
